The Arizona Adult Protective Services Act ("APSA"), provides one of the most strict and punitive laws in the nation designed to protect vulnerable adults from exploitation, abuse, and neglect. The APSA allows for a civil cause of action against an alleged wrongdoer. The most common form is financial exploitation, which occurs when: (1) there is a vulnerable adult above the age of 18, (2) a person is in a position of trust and confidence with the vulnerable adult, and (3) the person in a position of trust and confidences uses the vulnerable adult's assets for anything but the vulnerable adult’s sole benefit. The damages recoverable in a financial exploitation action can include repaying the amount taken/used, double damages, attorneys’ fees and costs, and registration on the Arizona Exploitation Registry.
